Regulations made by the Secretary of State, laid before Parliament under sections 8(4) and (7) and 26(5) to (7) of the Energy Prices Act 2022, for approval by resolution of each House of Parliament within twenty-eight days beginning with the day on which the Regulations were made, subject to extension for periods of dissolution, prorogation or adjournment for more than four days.

The Secretary of State makes the following Regulations in exercise of the powers conferred by section 8(4) and (7) of the Energy Prices Act 2022( 1).
1.—(1) These Regulations may be cited as the Energy Prices (Domestic Supply) (Northern Ireland) Regulations 2022 and come into force on 1st November 2022.
(2) These Regulations extend to Northern Ireland only.
(3) In these Regulations, “electricity supply licence” and “gas supply licence” have the meanings given in section 8(3) and (6) of the Energy Prices Act 2022 respectively.
2. “ NI domestic electricity supply” means the supply of electricity under an electricity supply licence—
(a) to premises at which the supply is taken wholly or mainly for a domestic purpose, or
(b) to premises not within sub-paragraph (a) but for which the tariff applied is one that the supplier also applies to supply within sub-paragraph (a).
3. “ NI domestic gas supply” means the supply of gas, under a gas supply licence, to premises at which the supply is taken wholly or mainly for a domestic purpose.

Section 5 of the Energy Prices Act 2022 (c. 44)provides for the establishment of schemes to reduce the amount that would otherwise be charged for domestic electricity and gas supply to customers in Northern Ireland. These Regulations define the terms “ NI domestic electricity supply” (regulation 2) and “ NI domestic gas supply” (regulation 3) for the purposes of the schemes which may be established under that section.

A full impact assessment has not been produced for this instrument as no, or no significant, impact on the private, voluntary or public sector is foreseen.
