The Secretary of State makes the following Regulations in exercise of the powers conferred by sections 42(1)(a), 56(2)(a), 88(3A), 114(2) and 123(4) of, and paragraph 4 of Schedule 6 to, the Planning Act 2008( 1):
1.—(1) These Regulations may be cited as the Infrastructure Planning (Prescribed Consultees and Interested Parties etc.) (Amendment) Regulations 2021.
(2) These Regulations come into force on 1st October 2021.
(3) An amendment made by these Regulations has the same extent and application as the provision amended.
2.—(1) The Infrastructure Planning (Applications: Prescribed Forms and Procedure) Regulations 2009( 2) are amended as follows.
(2) In column 1 (consultee) of the table in Schedule 1, in the entry relating to Public Health England, for “Public Health England” substitute “United Kingdom Health Security Agency”.
3.—(1) The Infrastructure Planning (Compulsory Acquisition) Regulations 2010( 3) are amended as follows.
(2) In column 1 (persons to be notified) of the table in Schedule 2, in the entry relating to Public Health England, for “Public Health England”substitute “United Kingdom Health Security Agency”.
4.—(1) The Infrastructure Planning (Changes to, and Revocation of, Development Consent Orders) Regulations 2011( 4) are amended as follows.
(2) In column 1 of the table in Schedule 1 (consultation and notification), in the entry relating to Public Health England, for “Public Health England”substitute “United Kingdom Health Security Agency”.
5.—(1) The Infrastructure Planning (Interested Parties and Miscellaneous Prescribed Provisions) Regulations 2015( 5) are amended as follows.
(2) In column 1 of the table in Schedule 1 (statutory parties), in the entry relating to Public Health England, for “Public Health England”substitute “United Kingdom Health Security Agency”.

These Regulations amend four statutory instruments relating to nationally significant infrastructure projects—
(a) the Infrastructure Planning (Applications: Prescribed Forms and Procedure) Regulations 2009 (regulation 2),
(b) the Infrastructure Planning (Compulsory Acquisition) Regulations 2010 (regulation 3),
(c) the Infrastructure Planning (Changes to, and Revocation of, Development Consent Orders) Regulations 2011 (regulation 4),
(d) the Infrastructure Planning (Interested Parties and Miscellaneous Prescribed Provisions) Regulations 2015 (regulation 5).
The amendments update references to Public Health England in lists of bodies contained in the above Regulations (lists of bodies to be consulted or notified) by replacing those references with references to the United Kingdom Health Security Agency. The United Kingdom Health Security Agency takes over relevant functions of Public Health England on 1st October 2021.
An impact assessment has not been published as no substantial impact on the private, public or voluntary sector is anticipated.

For the meaning of “prescribed” see section 235(1) of the Planning Act 2008.
