The Secretary of State makes the following Regulations in exercise of the powers conferred by sections 537(1)(a)(i) and (4), and 569(4) of the Education Act 1996(1).
1. These Regulations may be cited as the School Information (England) (Amendment) Regulations 2020 and come into force on 1st January 2021.
2.-(1) The School Information (England) Regulations 2008(2) are amended as follows.
(2) In Schedule 4 (specified information to be published on a school's website), after paragraph 15 insert-
"16.-(1) The number of school employees (if any) whose gross annual salary for employment at the school is equal to or exceeds £100,000, shown as the total number of those employees falling within salary bands of £10,000, starting from £100,000 and continuing upwards as appropriate.
(2) In this paragraph, "school employees" means persons employed as a member of staff of the school under a contract of employment with the governing body or local authority in accordance with section 35(2) or 36(2) of the Education Act 2002(3).
17.-(1) A link to the school's page on the Schools Financial Benchmarking website, where the school has a page, using the school's URN.
(2) In this paragraph-
(a)"Schools Financial Benchmarking website" means the online schools financial benchmarking service(4) maintained by the Department for Education; and
(b)"URN" means the unique reference number allocated to the school by the Department for Education for the purposes of identification and registration on the website known as "Get Information About Schools"(5) maintained by the Department.".

These Regulations amend the School Information (England) Regulations 2008 (S.I. 2008/3093) to require maintained schools to publish information relating to the number of school employees who earn £100,000 or more, and to publish a link to the school's webpage on the online Schools Financial Benchmarking service maintained by the Department for Education.
A full impact assessment has not been produced for this instrument as no, or no significant, impact on the private, voluntary or public sector is foreseen.
1996 c. 56 ("the 1996 Act"). By virtue of the National Assembly for Wales (Transfer of Functions) Order 1999 (S.I. 1999/672) the powers conferred by these sections are exercisable by the Secretary of State only in relation to England. Section 537(1) of the 1996 Act was substituted by paragraph 152(a) of Schedule 30 to the School Standards and Framework Act 1998 (c. 31); section 537(1)(a)(i) of the 1996 Act was amended by paragraph 7 of Part 1 of Schedule 2 to S.I. 2010/1158; section 537(4) of the 1996 Act was amended by paragraph 37 of Schedule 7 to the Education Act 1997 (c. 44); Section 569(4) of the 1996 Act was amended by section 8 of the Education (Wales) Measure 2009 (nawm 5). See section 579 of the 1996 Act for definitions of "prescribed" and "regulations".
