Her Majesty, in exercise of the powers conferred by section 98(8) of the Northern Ireland Act 1998(1), is pleased, by and with the advice of Her Privy Council, to order as follows.

In accordance with section 98(9) of that Act, a draft of this Order has been laid before and approved by resolution of each House of Parliament.

Citation and commencement

1.  This Order may be cited as the Adjacent Waters Boundaries (Northern Ireland) (Amendment) Order 2020 and comes into force on 31st December 2020.

Amendment to the Adjacent Waters Boundaries (Northern Ireland) Order 2002

2.-(1) The Adjacent Waters Boundaries (Northern Ireland) Order 2002(2) is amended as follows.

(2) In article 3(3) (the boundary of the Northern Ireland zone)-

(a) before sub-paragraph (a) insert-

"(za) follows the limit of the exclusive economic zone(3) from the co-ordinate numbered 1 in the Schedule to the co-ordinate numbered 1A in the Schedule,";

(b) in sub-paragraph (a)-

(i) at the beginning insert "then";

(ii) for "1" substitute "1A".

(3) In the Schedule (which lists co-ordinates)-

(a) after point 1, insert-

"1A 53° 43′ 55.776″ N : 05° 17′ 47.112″ W;"

(b) omit points 2 to 6.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order amends the Adjacent Waters Boundaries (Northern Ireland) Order 2002 (S.I 2002/791) ("the 2002 Order").

Section 98(1) of the Northern Ireland Act 1998 (c. 47) defines the "Northern Ireland zone" as meaning the sea within British fishery limits which is adjacent to Northern Ireland. For the purpose of that definition, the 2002 Order describes the boundary between the parts of the sea within British fishery limits which are to be treated as adjacent to Northern Ireland and the parts which are not. This Order amends Article 3 of the 2002 Order to make a minor correction to the boundary.

An impact assessment has not been produced for these Regulations as no, or no significant, impact on business, charities, voluntary bodies or the public sector is foreseen.

Section 41 of the Marine and Coastal Access Act 2009 (c. 23) provides that "exclusive economic zone" is to be read as a reference to any area designated by Order in Council under that section. The exclusive economic zone was designated by S.I. 2013/3161.
