The Secretary of State for Education makes the following Order in exercise of the powers conferred by section 122A(1) of the Education Reform Act 1988(1).
In accordance with section 122A(1) of the Education Reform Act 1988, it appears to the Secretary of State that the full-time equivalent enrolment number of the institution conducted by Hartpury College for courses of higher education exceeds 55 per cent of its total full-time equivalent enrolment number.
1.-(1) This Order may be cited as the Hartpury College (Transfer to the Higher Education Sector) Order 2018 and comes into force on 13th September 2018.
(2) This Order applies in relation to England.
2. On 13th September 2018, Hartpury College(2) is transferred to the higher education sector.

This Order, made under section 122A of the Education Reform Act 1988, provides for the transfer of Hartpury College from the further education sector to the higher education sector on 13th September 2018.
An impact assessment has not been produced for this instrument as it has no impact on businesses and civil society organisations. The instrument has no impact on the public sector. The Explanatory Memorandum is published alongside the instrument on www.legislation.gov.uk.
1988 c. 40; section 122A was inserted by section 74(1) of the Further and Higher Education Act 1992 (c. 13). Section 122A is amended by section 90 of, and paragraph 4 of schedule 8 to, the Higher Education and Research Act 2017 (c. 29), which has not yet come into force. By virtue of the National Assembly for Wales (Transfer of Functions) Order 1999 (S.I. 1999/672), as amended by S.I. 2000/1829, the power in section 122A is exercisable by the Secretary of State only in relation to England.
Hartpury College, whose address is Hartpury House, Hartpury, Gloucester GL19 3BE, was incorporated under section 15 of the Further and Higher Education Act 1992 (c.13) by the Education (Further Education Corporations) Order 1992 (S.I. 1992/2097).
