(This note is not part of the Regulations)
These Regulations bring into force sections 1 and 2 of the Armed Forces (Flexible Working) Act 2018 (c. 2) ("the 2018 Act") on the day after the day on which these Regulations are made. Section 3 of the 2018 Act (the only other provision of that Act) came into force on the day on which the Act was passed.
Section 1 of the 2018 Act amends section 329 of the Armed Forces Act 2006 (c. 52) ("the 2006 Act"). Section 329 of the 2006 Act enables the Defence Council to make regulations with respect to the terms and conditions of enlistment and service of persons enlisting, or who have enlisted, in the regular armed forces. The amendments made by section 1 of the 2018 Act enable those regulations to make provision for members of the regular armed forces to serve on a part-time basis and to serve subject to geographic restrictions.
Section 2 of the 2018 Act makes amendments consequential on the introduction of part-time service in the regular armed forces.
