1. This Order may be cited as the Animal Gatherings (Fees) (England) Order 2018 and comes into force on 30th June 2018.
2. In this Order-
"the 2010 Order" means the Animal Gatherings Order 2010(3);
"collection centre" means a premises where animals are collected for onward consignment within Great Britain;
"licensed premises" means a premises licensed under article 5(1) of the 2010 Order.
3.-(1) The fees payable to the Secretary of State for the issue, amendment or renewal of a licence under the 2010 Order are to be determined in accordance with Table 1 of the Schedule.
(2) The fees payable to the Secretary of State for the issue and renewal of a licence to organise shows or exhibitions under the 2010 Order are to be determined in accordance with Table 2 of the Schedule.
(3) Additional fees related to travel time and extra veterinary visits payable to the Secretary of State are to be determined in accordance with Table 3 of the Schedule.
(4) A person is exempt from a licence fee where the animal gathering on premises, or on the part of a premises to which the licence relates, involves-
(a)only shows or exhibitions that are open to the public for not more than one day at a time, in circumstances where no public sale or auction of animals takes place;
(b)a gathering solely for the purpose of an inspection to confirm that animals possess specific breed characteristics.

This Order makes provision for the introduction of fees payable to the Secretary of State for services provided by the Animal and Plant Health Agency, an executive agency of the Department for Environment, Food and Rural Affairs.
The fees introduced by article 3 relate to the licensing of certain types of animal gatherings for cattle, deer, goats, sheep and pigs as provided for under the Animal Gatherings Order 2010 (S.I. 2010/460).
The fees set out in column 2 in all three tables in the Schedule (other than travel time) are set at 50% of the full cost recovery for applications received and licensing related activities and veterinary visits undertaken by the Animal and Plant Health Agency on or before 30th June 2019.
The fees set out in column 3 in all three tables in the Schedule are set at 100% of the full cost recovery for applications received and licensing related activities and veterinary visits undertaken after 30th June 2019.
A full impact assessment has not been produced for this instrument as no, or no significant impact on the private, voluntary or public sectors is foreseen.
Functions conferred under this Act on the Minister of Agriculture, Fisheries and Food were transferred to the Secretary of State by S.I. 2002/794.
