1.-(1) This Order may be cited as the Animal Health (Miscellaneous Revocations) Order 2017 and comes into force on 1st January 2018.
(2) This Order applies to England only.
2. The following Orders are revoked-
(a)the Diseases of Animals (Extension of Definitions) Order 1971(3);
(b)the Disease Control (England) (Amendment) Order 2007(4).

This Order revokes two instruments relating to animal health which are spent or otherwise superseded.
The Diseases of Animals (Extension of Definitions) Order 1971 (S.I. 1971/531) which is revoked by article 2(a), applied to Great Britain and is revoked in relation to England.
An impact assessment has not been produced for this instrument as no impact on the private, voluntary or public sectors is foreseen.
Functions were conferred under sections 8(1) and 88(2) of the Animal Health Act 1981 on "the Ministers" (as defined in section 86(1) of that Act). Those functions were, so far as exercisable by the Secretaries of State for Scotland and Wales, transferred to the Minister of Agriculture, Fisheries and Food by the Transfer of Functions (Agriculture and Food) Order 1999 (S.I. 1999/3141), article 2(1) and the Schedule. They were transferred to the Secretary of State by the Ministry of Agriculture, Fisheries and Food (Dissolution) Order 2002 (S.I. 2002/794), article 2(2). Functions conferred on the Secretary of State, so far as exercisable in relation to Wales, were transferred to the National Assembly for Wales by the National Assembly for Wales (Transfer of Functions) Order 2004 (S.I. 2004/3044), article 2(a) and Schedule 1, and further transferred to the Welsh Ministers by virtue of the Government of Wales Act 2006 (c.32), Schedule 11, paragraphs 30 and 32. The functions of the Ministers were, in so far as within devolved competence, transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998 (c.46).
S.I. 1971/531. This Order was made under section 84(3)(a) of the Diseases of Animals Act 1950 (c.36) and, by virtue of section 17(2)(b) of the Interpretation Act 1978 (c.30), has effect as if made under section 88(2) of the Animal Health Act 1981. It was revoked, in relation to Scotland, by S.S.I. 2014/63.
