The Secretary of State makes these Regulations in exercise of the powers conferred by section 2(2) of the European Communities Act 1972(1).
The Secretary of State is designated(2) for the purposes of that section of that Act in relation to the environment.
1. These Regulations may be cited as the Bathing Water (Amendment) (England) Regulations 2016 and come into force on 20th June 2016.
2. In Part 1 of Schedule 2 (surface waters in England) to the Bathing Water Regulations 2013(3)-
(a)for "Burnham Jetty", substitute "Burnham Jetty North";
(b)for "Hastings", substitute "Hastings Pelham Beach";
(c)for "Mounts Bay Heliport", substitute "Mounts Bay Long Rock";
(d)in the appropriate places, insert-
(i)"West Runton";
(ii)"Windermere, Rayrigg Meadow";
(e)omit the following-
(i)"Lyme Regis Church Cliff Beach";
(ii)"Newhaven";
(iii)"Rock";
(iv)"Staithes".

These Regulations amend the Bathing Water Regulations 2013 (S.I. 2013/1675) ("the 2013 Regulations") which implement, in England and Wales, Directive 2006/7/EC of the European Parliament and of the Council concerning the management of bathing water quality and repealing Directive 76/160/EEC (OJ L 64, 4.3.2006, p 37).
Regulation 2 amends Part 1 of Schedule 2 to the 2013 Regulations to include two surface waters newly identified by the Secretary of State as bathing waters in England and to omit four surface waters no longer identified by the Secretary of State as bathing waters in England. The names of three bathing waters on the English list are also amended.
An impact assessment has not been produced for this instrument as no, or no significant, impact on the private, voluntary or business sector is foreseen.
