The Secretary of State for Transport in exercise of the powers conferred by sections 10, 12 and 325(1) of the Highways Act 1980(1), makes the following Order:
1. This Order may be cited as the A138 (Replacement Chelmer Viaduct) (Detrunking) Order 2016 and shall come into force on 14th April 2016.
2. In this Order –
(a)"classified road" as a classification for a highway, means that the highway is not a principal road for the purposes of enactments or instruments which refer to highways classified as principal roads but is a classified road for the purpose of every enactment and instrument which refers to highways classified by the Secretary of State for Transport and which does not specifically refer to their classification as principal roads;
(b)"the trunk road" means the A138 Trunk Road as described in the Schedule to this Order; and
(c)"the plan" means the plan numbered HA XX/XX/XXX marked "The A138 (Replacement Chelmer Viaduct) (Detrunking) Order 2016", signed by authority of the Secretary of State for Transport and deposited at Document Deposit Service, Communities and Local Government, Floor 12 (IMD), Ashdown House, St. Leonards on Sea, Hastings, East Sussex TN37 7GA
3. The length of the trunk road described in the Schedule to this Order shall cease to be a trunk road and shall be classified as a classified road as from the date on which this Order comes into force.

The length of the trunk road ceasing to be a trunk road is the A138 Chelmer Road, a route approximately 0.94 kilometres in length, between the Army & Navy Roundabout and the Chelmer Village Way Roundabout at Chelmsford, in the County of Essex and is shown by broad black dashes on the plan.

This Order authorises the detrunking of the existing A138 Chelmer Road, a length of approximately 0.94 kilometres between the Army and Navy Roundabout and the Chelmer Village Way Roundabout, Chelmsford in the County of Essex.
1980 c.66 section 10 was amended by the New Roads and Street Works Act 1991 (c.22)(2)
