The Secretary of State for Health makes these Regulations in exercise of the powers conferred by sections 176(1) and 272(7) and (8) of the National Health Service Act 2006(1).
1.-(1) These Regulations may be cited as the National Health Service (Dental Charges) (Amendment) Regulations 2016.
(2) These Regulations come into force on 1st April 2016.
(3) In these Regulations, "the Dental Charges Regulations" means the National Health Service (Dental Charges) Regulations 2005(2).
2. In regulation 4 of the Dental Charges Regulations(3) (calculation of charges)-
(a)in paragraph (1), for "£18.80" substitute "£19.70";
(b)in paragraph (2), for "£51.30" substitute "£53.90";
(c)in paragraph (3), for "£222.50" substitute "£233.70";
(d)in paragraph (4), for "£222.50" substitute "£233.70"; and
(e)in paragraph (5), for "£18.80" substitute "£19.70".
3. In regulation 12A of the Dental Charges Regulations(4) (charges in respect of primary dental services provided under a prototype agreement or under a Capitation and Quality Scheme 2 Agreement)-
(a)in the heading, omit "or under a Capitation and Quality Scheme 2 Agreement";
(b)in paragraph (1), omit "or under a Capitation and Quality Scheme 2 Agreement"; and
(c)in paragraph (2), for "£18.80" substitute "£19.70".
4. In regulation 12B of the Dental Charges Regulations(5) (transitional provision relating to interim care provided under a Capitation and Quality Scheme 2 Agreement)-
(a)in paragraph (a), for "31st October 2015" substitute "31st March 2016";
(b)in paragraph (b), for "1st November 2015" substitute "1st April 2016"; and
(c)in paragraph (c), for "1st November 2015" substitute "1st April 2016".

These Regulations amend the National Health Service (Dental Charges) Regulations 2005 ("the Dental Charges Regulations").
Regulation 2 amends regulation 4 of the Dental Charges Regulations to increase the charges for Band 1 courses of treatment from £18.80 to £19.70, Band 2 courses of treatment from £51.30 to £53.90 and Band 3 courses of treatment from £222.50 to £233.70.
Regulations 3 and 4 make amendments to regulations 12A and 12B respectively of the Dental Charges Regulations to reflect the termination of the Capitation and Quality Scheme 2 on 31st March 2016. Regulation 3 also increases the charge for a Band 1A interim care course of treatment provided by contractors participating in the Prototype Agreement Scheme from £18.80 to £19.70 in line with Band 1.

2006 c.41. Section 176 of the National Health Service Act 2006 ("the Act") was amended by section 55(1) of, and paragraph 94 of Schedule 4 to, the Health and Social Care Act 2012 (c.7). See section 275(1) of the Act for the definitions of "prescribed" and "regulations" which are relevant to the powers being exercised. By virtue of section 271(1) of the Act, the powers being exercised by the Secretary of State in the making of these Regulations are exercisable only in relation to England.
