The Secretary of State makes these Regulations in exercise of the powers conferred by sections 70(2) and (3) and 104(1) of the Control of Pollution Act 1974(1).
1. These Regulations-
(a)may be cited as the Control of Noise (Appeals) (Amendment) (England) Regulations 2016;
(b)come into force on 6th April 2016; and
(c)apply to England only.
2.-(1) The Control of Noise (Appeals) Regulations 1975(2) are amended as follows.
(2) Omit regulation 7 (appeals under section 66(7)).
(3) Omit Part 3 (appeals to the Secretary of State).
(4) In regulation 10 (suspension of notices)-
(a)in paragraph (1), after "a notice served under section 60" omit ", or 66"; and
(b)in paragraph (3), after "magistrates' court" omit "or the Secretary of State".

These Regulations amend the Control of Noise (Appeals) Regulations 1975 to remove provisions about appeals to the Secretary of State under sections 64 to 67 of the Control of Pollution Act 1974, due to the repeal of those sections by Part 5 of Schedule 13 to the Deregulation Act 2015. The amendments apply only to England.
A full impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen.
