The Secretary of State makes the following Order in exercise of the powers conferred by sections 89(3), 90(2) and 459(2) of the Proceeds of Crime Act 2002(1).
1.-(1) This Order may be cited as the Proceeds of Crime Act 2002 (Appeals under Part 2) (Amendment) Order 2015.
(2) This Order comes into force on 30th November 2015.
2.-(1) The Proceeds of Crime Act 2002 (Appeals under Part 2) Order 2003(2) is amended as follows.
(2) In article 11 (leave to appeal to Supreme Court), before "33" insert "13B(4),(3)".
(3) In article 12 (application for leave to appeal), in paragraph (1), before "33" insert "13B(4),".
(4) In article 14 (presence at hearing), before "33" insert "13B(4),".

This Order amends the Proceeds of Crime Act 2002 (Appeals under Part 2) Order 2003 (S.I. 2003/82) to insert in Part 3 of the Order references to an appeal to the Supreme Court under section 13B(4) of the Proceeds of Crime Act 2002 (c. 29). Section 13B was inserted into the Proceeds of Crime Act 2002 by section 7 of the Serious Crime Act 2015 (c. 9) which came into force on 1st June 2015.
An impact assessment has not been produced for this instrument as no impact is foreseen on the private, voluntary or public sectors.
