(This note is not part of the Regulations)
Section 5(1) of the Public Passenger Vehicles Act 1981 requires every traffic commissioner to publish such information with regard to the exercise of the commissioner's functions as may be prescribed.
The Public Service (Traffic Commissioners: Publication and Inquiries) Regulations 1986 prescribe the information to be published in accordance with the section. In particular, regulation 3(1) requires that a traffic commissioner publish specified information relating to local bus services registered under section 6 of the Transport Act 1985, which includes (sub-paragraph (a)(vi)) the types of vehicle to be used.
The present Regulations remove the reference to this type of information as this is no longer required to be provided to traffic commissioners with applications for registration of a local bus service (see regulation 4 of the Public Service Vehicles (Registration of Local Services) Regulations 1986 (S.I. 1986/1671 as amended by S.I. 2004/10) and regulation 5 of the Public Service Vehicles (Registration of Local Services) (Scotland) Regulations 2001 (S.S.I. 2001/219, as substituted by S.S.I. 2012/32)).
An impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen.
1981 c.14; section 5(1) was substituted by section 3(2) of the Transport Act 1985 (c.67); section 60(1) was amended by section 134(2) of, and Schedule 8 to, that Act and section 60(2) was amended by section 134(2) of that Act.
S.I. 1986/1629, to which there are amendments but none is relevant.
