(This note is not part of the Order)
Under section 128 of the Serious Organised Crime and Police Act 2005 it is an offence to enter or be on any designated site in England and Wales or Northern Ireland as a trespasser. A "designated site" is a site specified or described in an order made under section 128 which designates the site for the purpose of that section. Article 2(6) of the Serious Organised Crime and Police Act 2005 (Designated Sites under Section 128) Order 2007 ("the 2007 Order") designates the Government Communications Headquarters site at Racecourse Road, Scarborough, North Yorkshire, YO12 5TQ, as marked in Schedule 5 to the 2007 Order. Article 2 of this Order has the effect of substituting a new Schedule 5 to the 2007 Order which contains an updated map marking the new boundary line of the GCHQ site on which it is an offence to trespass.
A full regulatory impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen.
2005 c.15. Section 128 has been amended by section 12 of the Terrorism Act 2006 (c. 11).
