The Secretary of State makes the following Order in exercise of the powers conferred by section 241(3)(c) and (8) of the Enterprise Act 2002(1).
1. This Order may be cited as the Enterprise Act 2002 (Part 9 Restrictions on Disclosure of Information) (Specification) Order 2013 and comes into force on 16th August 2013.
2. The Green Deal Framework (Disclosure, Acknowledgment, Redress etc.) Regulations 2012(2) are specified for the purposes of section 241(3)(c) of the Enterprise Act 2002.

Part 9 of the Enterprise Act 2002 ("the Act") restricts the disclosure of "specified information" which relates to the affairs of an individual or any business of an undertaking. "Specified information" is defined by section 238 of the Act. Section 241(3) of the Act provides that a public authority may disclose specified information which it holds and is restricted by Part 9 of the Act, to any other person for the purposes of facilitating the exercise of functions that person has under or by virtue of the Act, an enactment specified in Schedule 15 or any subordinate legislation specified for the purposes of section 241(3)(c).
Article 2 specifies the Green Deal Framework (Disclosure, Acknowledgment, Redress etc.) Regulations 2012 for the purposes of section 241(3)(c) of the Act.
A full regulatory impact assessment has not been produced for this instrument as no impact on the private, voluntary or public sectors is foreseen.
