The Secretary of State for Health makes these Regulations in exercise of the powers conferred by sections 104, 109 and 272(7) of the National Health Service Act 2006 (1).
1. These Regulations may be cited as the National Health Service (Primary Dental Services) (Amendments Related to Units of Dental Activity) Regulations 2012 and come into force on 1st November 2012.
2. In Schedule 2 (provision of services: units of dental activity and units of orthodontic activity), to the National Health Service (General Dental Services Contracts) Regulations 2005(2), in paragraph 2 (units of dental activity), in Table B (units of dental activity provided under the contract in respect of charge exempt courses of treatment)-
(a)in the first column (type of charge exempt course of treatment), omit "Issue of a prescription"; and
(b)in the corresponding entry in the second column (units of dental activity provided), omit "0.75".
3. In Schedule 2 (provision of services: units of dental activity and units of orthodontic activity), to the National Health Service (Personal Dental Services Agreements) Regulations 2005(3) in paragraph 2 (units of dental activity), in Table B (units of dental activity provided under the agreement in respect of charge exempt courses of treatment)-
(a)in the first column (type of charge exempt course of treatment), omit "Issue of a prescription"; and
(b)in the corresponding entry in the second column (units of dental activity provided), omit "0.75".

These Regulations amend the National Health Service (General Dental Services Contracts) Regulations 2005 ("the GDS Regulations") and the National Health Service (Personal Dental Services Agreements) Regulations 2005 ("the PDS Regulations").
Regulations 2 and 3 respectively amend paragraph 2 of Schedule 2 to the GDS Regulations and paragraph 2 of Schedule 2 to the PDS Regulations by removing from the type of charge exempt course of treatment for which units of dental activity are provided the issue of a prescription.
A full Impact Assessment has not been produced for this instrument as no impact on the private or voluntary sector is foreseen.
2006 c.41. By virtue of section 271(1) of the Act, the powers conferred by these sections are exercisable by the Secretary of State only in relation to England.
