Coming into force in accordance with article 1
At the Court at Windsor Castle, the 10th day of July 2012
Present,
The Queen's Most Excellent Majesty in Council
Her Majesty is satisfied, to the extent this Order relates to a country that is not a Convention country nor another member State of the European Union, that provision has been made or will be made under the law of that country, giving adequate protection to the owners of copyright in respect of works under Part 1 of the Copyright, Designs and Patents Act 1988(1).
Accordingly, Her Majesty, by and with the advice of Her Privy Council, in exercise of the powers conferred on Her by section 159 of the Copyright, Designs and Patents Act 1988(2), makes the following Order:
1.-(1) This Order may be cited as the Copyright and Performances (Application to Other Countries) (Amendment) Order 2012.
(2) The provisions of this Order come into force on the day on which Part 1 of the Intellectual Property (Unregistered Rights) (Jersey) Law 2011(3) comes into force in its entirety.
2.-(1) The Copyright and Performances (Application to Other Countries) Order 2012(4) is amended as follows.
(2) In the first four columns of the Schedule, after the entry relating to Japan, insert-

Clerk of the Privy Council
(This note is not part of the Order)
This Order amends the Copyright and Performances (Application to Other Countries) Order 2012 (S.I.2012/799).
The amendments made by Article 2(2) to add an entry relating to Jersey in the Schedule to SI 2012/799 are in consequence of the repeal of the provisions of the Copyright Act 1911 as they apply to Jersey and their replacement by Part 1 of the Intellectual Property (Unregistered Rights) (Jersey) Law 2011. The amendments to SI 2012/799 ensure continuity of protection in the United Kingdom of copyright works created in Jersey.
No impact assessment has been prepared in relation to this instrument as no impact on the private or voluntary sectors is foreseen. An Explanatory Memorandum is available alongside the instrument on www.legislation.gov.uk.
Section 159 was amended by regulation 2(2) of, and Schedule 2 to, the Copyright and Related Rights Regulations 2003 S.I. 2003/2498.
