1. These Regulations may be cited as the Ecodesign for Energy-Related Products (Amendment) Regulations 2011 and come into force on 1st December 2011.
2.-(1) The Ecodesign for Energy-Related Products Regulations 2010(3) are amended as follows.
(2) After regulation 20 insert-
"21.-(1) The Secretary of State must from time to time-
(a)carry out a review of regulations 2 to 19,
(b)set out the conclusions of the review in a report, and
(c)publish the report.
(2) In carrying out the review the Secretary of State must, so far as is reasonable, have regard to how Commission Directive 2009/125/EC(4) (which is implemented by means of regulations 2 to 19) is implemented in other Member States.
(3) The report must in particular-
(a)set out the objectives intended to be achieved by the regulatory system established by those Regulations,
(b)assess the extent to which those objectives are achieved, and
(c)assess whether those objectives remain appropriate and, if so, the extent to which they could be achieved with a system that imposes less regulation.
(4) The first report under this regulation must be published before the end of the period of 5 years beginning with the day on which these Regulations come into force.
(5) Reports under this regulation are afterwards to be published at intervals not exceeding 5 years".
(3) In Schedule 1, in the table at paragraph 4 after item 10 insert-
"11 | A household dishwasher | Commission Regulation (EU) No 1016/2010 implementing Directive 2009/125/EC of the European Parliament and of the Council with regard to the ecodesign requirements for household dishwashers(5) |
12 | A household washing machine | Commission Regulation (EU) No 1015/2010 implementing Directive 2009/125/EC of the European Parliament and of the Council with regard to the ecodesign requirements of household washing machines(6)" |
(4) In Schedule 5, in paragraph 27(2) for "two months" substitute "28 days".
3. For regulation 7(3)(a) of the Energy Information Regulations 2011(7) substitute-
"(a)make the documentation available for inspection purposes when placing a product on the market or putting it into service, and keep the documentation available until at least 5 years after the date the last product concerned was manufactured".

These Regulations-
(a)insert two additional products (household dishwashers and household washing machines) into the table in Schedule 1 to the Ecodesign for Energy Related Products Regulations 2010 (S.I. 2010/1552);
(b)add a requirement for the Secretary of State to review those Regulations no later than 5 years beginning on the day they came into force;
(c)reduce the time for appeals to the First-tier Tribunal under paragraph 27(2) of Schedule 5 from two months to 28 days;
(d)amend the Energy Information Regulations 2011 (S.I. 2011/1524) to require persons to make technical documentation available from the time when the person placed products on the market or puts them into service and to keep them available from the time of placing on the market or putting into service for a period of at least 5 years after the last date of manufacture of that product.
A full impact assessment has not been produced for this instrument as no impact on the private, voluntary or public sectors is foreseen.
