This is a case where the Secretary of State for Education, in accordance with section 125(2)(b) of the Education Act 2002(1) ("the Act"), has consulted the chair of the School Teachers' Review Body about disapplying section 125(1) of the Act.
In accordance with section 126 of the Act(2) the Secretary of State for Education has consulted such of the persons and bodies referred to in that section as appeared to him to be appropriate.
The Secretary of State for Education makes the following Order in exercise of the powers conferred by section 122(1)(b) of the Act.
1. This Order may be cited as the School Teachers' Pay and Conditions (Amendment) Order 2011 and comes into force on 25th February 2011.
2.-(1) The School Teachers' Pay and Conditions Order 2010(3) is amended as follows.
(2) After article 2 insert the following-
2A. The Document has effect in relation to the school year(4) beginning in 2010 as if-
(a)in paragraph 47.1, and in paragraph 62.2 (both places), the references to 195 days were references to 194 days;
(b)in paragraph 62.2(a) the reference to 190 days were a reference to 189 days;
(c)in paragraphs 62.4, 62.5, 62.11 and 63.5 the references to 1265 hours were references to 1258.5 hours.".

This Order amends the School Teachers' Pay and Conditions Order 2010, S.I. 2010/1979. The School Teachers' Pay and Conditions Document 2010 ("the Document") which is given legal effect by that Order, is modified in relation to the school year beginning in 2010 to reduce by one the number of days for which a teacher must be available for work in that school year, and to make corresponding modifications in relation to the number of hours during which teachers can be required to perform their duties in that school year. The reason for the changes is the additional bank holiday taking place in April 2011. The modifications to the Document are published alongside the Document on the website of the Department for Education (www.education.gov.uk).
Section 126 of the Education Act 2002 was amended by S.I. 2010/1158.
