The Secretary of State is a Minister designated(1) for the purposes of section 2(2) of the European Communities Act 1972(2) in relation to measures relating to the interruption or reduction, in part or completely, of economic relations with one or more countries which are not Member States.
The Secretary of State, in exercise of the powers conferred by section 2(2) of the European Communities Act 1972 and by sections 1, 2, 3, 4, 5 and 7 of the Export Control Act 2002(3), makes the following Order:
1. This Order may be cited as the Export Control (Burma) (Amendment) Order 2010 and shall come into force on 26th June 2010.
2. In article 1(2) of the Export Control (Burma) Order 2008(4)–
(a) omit the definition of "a Community authorisation";
(b) at the appropriate place insert–
""an EU authorisation" means an authorisation granted under Article 2(5), 5(3), 8(2) or 9 of the Regulation;";
(c) in the definition of "the Regulation", after "194/2008" insert "as last amended by Council Regulation (EU) No 408/2010(5)".
3. In articles 9 and 11(2) of the Export Control (Burma) Order 2008, for "Community" wherever it appears substitute "EU".

The Export Control (Burma) Order 2008 contains provisions to give effect to Council Regulation (EC) No 194/2008 concerning restrictive measures against Burma. This Order amends the 2008 Order to take account of amendments to the 2008 Regulation. The amendments affect the sanctions related to round logs, timber and timber products, coal and certain metals and precious and semi-precious stones. The 2008 Regulation as amended allows Member States to authorise the purchase of these products from Burma in specified circumstances such as, for example, where the goods are for a humanitarian aid project or programme.
The opportunity has also been taken to update references in the 2008 Order to "Community authorisations" to reflect the changes of terminology effected by the Lisbon Treaty.
A full impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen.
