The Secretary of State for Business, Innovation and Skills, in exercise of the power conferred by section 178(2) of the Apprenticeships, Skills, Children and Learning Act 2009(1), makes the following Order:
1. This Order may be cited as the Qualifications and Curriculum Development Agency´s Remit Order 2010 and comes into force on 1st April 2010.
2. For the purposes of Part 8 of the Apprenticeships, Skills, Children and Learning Act 2009, qualifications when taken by a person aged 19 or over are outside the Qualifications and Curriculum Development Agency´s remit.

This Order provides that qualifications when they are taken by a person aged 19 or over are outside the remit of the Qualifications and Curriculum Development Agency ("QCDA") for the purposes of Part 8 of the Apprenticeships, Skills, Children and Learning Act 2009. Part 8 of that Act sets out the functions of the QCDA which apply in relation to qualifications within its remit.
A full impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen.
