The Secretary of State for Transport makes the following Regulations in exercise of the powers conferred by section 80(1) of the Road Traffic Act 1988(1).
Representative organisations have been consulted in accordance with section 195(2) of that Act.
1. These Regulations may be cited as the Motor Vehicles (Designation of Approval Marks) (Amendment) Regulations 2010 and come into force on 23rd March 2010.
2. The Motor Vehicles (Designation of Approval Marks) Regulations 1979(2) are amended as follows.
3. In Schedule 2 after item 30A insert–
"30B | E11 012439 S | Pneumatic tyre for motor vehicles and their trailers. | The tyre | 117 | 16th October 1995 | 1, 2 and 20" |

4. After paragraph 19, add–
"20. In relation to the marking prescribed at item 30B, the suffix "S" shall be added to the number mentioned in paragraph 2 above to show that the tyre complies with the requirements on tyre rolling noise sound emissions in the ECE Regulation referred to in column (5) of Schedule 2.".
5.–(1) In Schedule 4 is amended as follows.
(2) In item 33–
(a) In column 5(a), add at the end "as amended by Directive 2001/43/EC of 27 June 2001"; and
(b) In column 5(b), at the end insert "and O.J. L211, 4.8.2001, p.25".
6. At the end of paragraph 15 of Schedule 5, insert–
"The suffix "-s" shall be added to the number to show that the tyre complies with the noise emission requirements in Annex V of the Community Instrument referred to in column (5) of Schedule 4."

These Regulations amend the Motor Vehicles (Designation of Approval Marks) Regulations 1979 (the "1979 Regulations") by designating a new approval mark for the purposes of the Trades Description Act 1968, and amending the application of a current approval mark.
These Regulations are designating marks provided for in UNECE Regulation 117 and Council Directive 92/23/EEC of 31 March 1992 (OJ No. L129, 14.5.1992, p.95) as amended by Directive 2001/43/EC of the European Parliament and the Council of 27 June 2001 (OJ No. L211, 4.8.2001, p.25).
Regulation 3 inserts item 30B, a new approval mark, into Schedule 2. Regulation 4 adds paragraph 20 to Schedule 3, which allows for a new permitted variation in respect of item 30B. Regulation 5 amends item 33 of Schedule 4 by updating the description and Official Journal reference of the Community Instrument. Regulation 6 amends paragraph 15 of Schedule 5 by inserting an additional variation.
