The Secretary of State for Transport makes these Regulations in exercise of the powers conferred by section 89(3)(1) of the Road Traffic Act 1988(2).
The Secretary of State for Transport has consulted with representative organisations in accordance with section 195(2) of the 1988 Act.
1. These Regulations may be cited as the Motor Vehicles (Driving Licences) (Amendment) (No. 2) Regulations 2009 and shall come into force on 28th September 2009.
2. In regulation 40B (content of the tests) of the Motor Vehicles (Driving Licences) Regulations 1999(3) in paragraph (1)(a) omit "consisting of 50 questions, the questions being in either multiple choice or multiple response form and".

These Regulations amend the Motor Vehicles (Driving Licences) Regulations 1999 in relation to the content of the driving theory test for cars, motorcycles and mopeds by removing the requirement for that test to consist of 50 questions in multiple choice or multiple response form.
A full impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen.
Section 89(3) was amended by the Road Traffic Act 1991 (c.40), Schedule 4, paragraph 63 and by the Road Safety Act 2006 (c.49), section 36. Back [1]
