The Secretary of State is a Minister designated for the purposes of section 2(2) of the European Communities Act 1972(1) in relation to the creation, operation, regulation or dissolution of companies and other forms of business organisation(2).
In exercise of the powers conferred by section 2(2) of that Act the Secretary of State makes the following Regulations:
1. These Regulations may be cited as the Companies (Cross-Border Mergers) (Amendment) Regulations 2008 and come into force on 6th April 2008.
2. In regulation 19(5) of the Companies (Cross-Border Mergers) Regulations 2007(3), for "paragraph (1) or (2)" substitute "paragraph (1) or (3)".

These Regulations correct an error in regulation 19(5) of the Companies (Cross-Border Mergers) Regulations 2007. That provision creates an offence of failing to comply with requirements to deliver documents. It refers, however, to a provision which does not provide for such requirements instead of to a provision which does. These Regulations replace the reference with a correct reference to a provision which provides for such requirements.
