The Secretary of State makes the following Order in exercise of the powers conferred by section 15(2) of the Immigration, Asylum and Nationality Act 2006(1).
In accordance with section 20(2) of that Act, a draft of this instrument was laid before Parliament and approved by a resolution of each House of Parliament.
1. This Order may be cited as The Immigration (Employment of Adults Subject to Immigration Control) (Maximum Penalty) Order 2008 and shall come into force on 29th February 2008.
2. For the purposes of section 15(2) of the Immigration, Asylum and Nationality Act 2006 (employment of adults subject to immigration control: penalty notice) the prescribed maximum is £10,000.

This Order specifies the maximum penalty which may be imposed by the Secretary of State under section 15(2) of the Immigration, Asylum and Nationality Act 2006 on an employer who acts contrary to that section in the employment of an adult subject to immigration control.
