Continuity of employment

Where rights, liabilities and obligations under or in relation to a contract of employment are transferred by virtue of article 3(d), the contract has effect from 1st July 2007 as if originally made between the employee and the TSB.

In 1992, the powers conferred on the Secretary of State by section 5(1) were made exercisable concurrently with the Minister for the Civil Service and the Chancellor of the Duchy of Lancaster (articles 2(2)(a) and 3 of S.I. 1992/1296), but from 1st January 1996, they were vested solely in the Secretary of State (articles 3(3)(a) and 5(1) of, and paragraph 1(2) of the Schedule to, S.I. 1995/2985).
