The Secretary of State, in exercise of the powers conferred by section 166(3) of, and paragraphs 1, 3(a) and 12 of Schedule 8 to, the Immigration and Asylum Act 1999[
1], makes the following Regulations:
Citation and commencement
1.
These Regulations may be cited as the Asylum Support (Amendment) Regulations 2007 and shall come into force on 9th April 2007.
Amendment of regulation 3(3) of the Asylum Support Regulations 2000
2.
In regulation 3(3) of the Asylum Support Regulations 2000 ("the 2000 Regulations")[
2] delete "; and any form so issued shall be the form shown in the Schedule to these Regulations or a form to the like effect".
Kind and levels of support for essential living needs
3.
For the table at regulation 10(2) of the 2000 Regulations substitute:

Revocation of the Schedule to the 2000 Regulations
4.
The Schedule to the 2000 Regulations is revoked.
Revocation of the Asylum Support (Amendment) Regulations 2006
5.
The Asylum Support (Amendment) Regulations 2006[3] are revoked.

EXPLANATORY NOTE
(This note is not part of the Regulations)
Regulations 2 and 4 amend regulation 3(3) of, and revoke the Schedule to, the Asylum Support Regulations 2000 ("the 2000 Regulations") so that there is no longer a requirement that the application form issued by the Secretary of State is the form shown in the Schedule.
Regulation 3 amends regulation 10(2) of the 2000 Regulations by increasing the cash amounts payable, as a general rule, in respect of a person's essential living needs. These changes take effect from 9th April 2007 and on that date the Asylum Support (Amendment) Regulations 2006, which set out the amounts previously payable, are revoked.
A full regulatory impact assessment has not been produced for this instrument as no impact on the private or voluntary sector is foreseen.
