The Local Government (Best Value) Performance Indicators and Performance Standards (England) (Amendment) Order 2007

  Made 26th February 2007 
  Laid before Parliament 7th March 2007 
  Coming into force 1st April 2007 

The Secretary of State for Communities and Local Government makes the following Order in exercise of the powers conferred by sections 4(1) and (2) and 28(1)(b) of the Local Government Act 1999[1].

     In accordance with section 4(3) of that Act, she has consulted persons appearing to her to represent the best value authorities concerned and such other persons as she thought fit.

Citation and commencement
     1. This Order may be cited as the Local Government (Best Value) Performance Indicators and Performance Standards (England) (Amendment) Order 2007 and shall come into force on 1st April 2007.

Amendment of the Local Government (Best Value) Performance Indicators and Performance Standards (England) Order 2005
    
2. The Local Government (Best Value) Performance Indicators and Performance Standards (England) Order 2005[2] is amended as follows.

Performance standards for waste authorities and specific waste authorities
     3. —(1) In articles 11 and 12, for "1st April 2005" substitute "1st April 2007".

    (2) For Schedules 9 and 10 substitute the provisions in the Schedule to this Order.

Performance standards for major planning applications
    
4. For article 16(4) substitute—

        " (4) The best value authorities specified for the purposes of paragraph (1) are—

    Performance Standards for Waste Authorities


    (1) (2)
    Authority's 1998–9 recycling and composting rate Minimum amount of waste which must be sent for recycling or composting in 2007/2008
    6% or less Percentage of household waste sent for recycling and composting is at least 20% of all household waste collected.
    More than 6% but less than 13% Percentage of household waste sent for recycling or composting is at least treble that achieved for the financial year beginning on 1st April 1998, or at least 30% , whichever is the smaller.
    13% or more Percentage of household waste sent of recycling and composting is at least 30% of all household waste collected.

EXPLANATORY NOTE

(This note is not part of the Order)


The Local Government (Best Value) Performance Indicators and Standards (England) Order 2005 (the 2005 Order) sets performance indicators and standards for best value authorities in England excluding police authorities.

This Order amends articles 11 and 12, 16(4), 17(3) and 18(3) of the 2005 Order and replaces Schedules 9 and 10 to that Order.

Article 3 amends article 11 of the 2005 Order and inserts a replacement Schedule 9. The effect of the amendments is to specify performance standards for the financial year beginning on 1st April 2007 for best value waste authorities (apart from those specified in Schedule 10) in relation to their waste functions. Article 3 also amends article 12 of the 2005 Order and inserts a replacement Schedule 10.The effect of the amendments is to specify performance standards for the financial year beginning on 1st April 2007 for the named waste authorities in relation to their waste functions.

Article 4 amends the list of authorities subject to performance standards for major planning applications set out in article 16(4) of the 2005 Order.

Article 5 amends the list of authorities subject to performance standards for minor planning applications set out in article 17(3) of the 2005 Order.

Article 6 amends the list of authorities subject to performance standards for other planning applications set out in article 18(3) of the 2005 Order.

A full regulatory impact assessment has not been produced for this instrument with respect to provisions in this Order concerned with performance standards for planning applications as no impact on the private or voluntary sectors is foreseen.
