In exercise of the powers conferred on the Secretary of State by sections 19 and 42(6) of the Teaching and Higher Education Act 1998[
1] the Secretary of State for Education and Skills makes the following Regulations:
Citation, commencement and application
1.
These Regulations may be cited as the Education (Induction Arrangements for School Teachers) (Consolidation) (England) (Amendment) Regulations 2007 and come into force on 5th March 2007.
2.
These Regulations apply in relation to England.
Amendment to the Education (Induction Arrangements for School Teachers) (Consolidation) (England) Regulations 2001

The Education (Induction Arrangements for School Teachers) (Consolidation) (England) Regulations 2001[
2] are amended as follows.

In regulation 16A—
(a) for paragraph (1) substitute—
"
(1) This regulation applies in the case of a teacher who qualified between 1st May 2000 and 30th April 2001 and who—
(a) has completed an induction period or an extended induction period under regulation 16(3) (in either case whether or not extended pursuant to regulation 16A(5) of these Regulations as they had effect immediately before the Education (Induction Arrangements for School Teachers) (Consolidation) (England) (Amendment) Regulations 2007 ("the 2007 Regulations") come into force); or
(b) would, apart from this regulation, complete an induction period or an extended induction period under regulation 16(3), after the 2007 Regulations come into force, but before 27th April 2007,
and, at the time when that induction period or extended induction period, as the case may be, was or is completed (disregarding for this purpose any extension made by this regulation, either as it had effect immediately before or after the 2007 Regulations come into force) achieved the induction standards mentioned in regulation 15 save that, on—
(b) in paragraph (3), for "1st January 2002" substitute "27th April 2007";
(c) for paragraphs (4) and (5) substitute the following—
"
(4) The induction period of a person whose induction period was completed before the date on which the 2007 Regulations come into force is revived on that date and extended until 27th April 2007 or until the date, if earlier, when the person passes the numeracy skills test.
(5) The induction period of a person whose induction period would, apart from this paragraph, be completed on or after the date on which the 2007 Regulations come into force but before 27th April 2007, is extended until 27th April 2007 or until the date, if earlier, when the person passes the numeracy skills test.".

In regulation 18A—
(a) in paragraph (1)(b)—
(i) in sub-paragraph (i) for "on 31st August 2002" substitute "on 27th April 2007"; and
(ii) in sub-paragraph (ii) after "induction period" insert "or extended induction period";
(b) in paragraph (3) for "after 31st August 2002" substitute "after 27th April 2007"; and
(c) in paragraph (4) for "on completion of his induction period or extended induction period" substitute "as soon as practicable after 27th April 2007 or at the end, if later, of the induction period or extended induction period".

In paragraph 2 of Schedule 2, after "regulation 16" insert ", 16A".

EXPLANATORY NOTE
(This note is not part of the Regulations)
These Regulations, which come into force on 5th March 2007, amend the Education (Induction Arrangements for School Teachers) (Consolidation) (England) Regulations 2001(S.I. 2001/2897) ("the principal Regulations"). They only affect teachers who—
(a) qualified between 1st May 2000 and 30th April 2001,
(b) completed their induction period either before the coming into force of these Regulations or complete their induction period after coming into force but before 27th April 2007, and
(c) have not, either on the coming into force of these Regulations or when they complete their induction period if later, passed the numeracy skills test.
These Regulations extend the induction period of these teachers to 27th April 2007 or the date, if earlier, on which they pass the numeracy skills test (regulation 4). They also extend the time for passing the test to 27th April 2007 (regulation 5). They ensure that a teacher whose induction period is extended in accordance with regulation 16A of the principal Regulations is lawfully employed during that extension (regulation 6).
A further effect is that the employer of a person who has not passed that test by that date or at the end of the induction period if later, must, pursuant to regulation 18 of the principal Regulations, secure the termination of that person's employment as a teacher.
