The Secretary of State, with the approval of the Treasury, makes the following Order in exercise of the powers conferred by section 32(3) of the Animal Health Act 1981[
1] and now vested in him[
2]:
Title, commencement and application
1.
This Order—
(a) may be cited as the Equine Infectious Anaemia (Compensation) (England) Order 2006;
(b) comes into force on 6th November 2006;
(c) applies in England only.
Compensation for equine animals slaughtered for equine infectious anaemia
2.
—(1) Where the Secretary of State causes a diseased equine animal to be slaughtered under the powers conferred by section 32 of the Animal Health Act 1981 in its application to equine infectious anaemia, the amount of compensation payable in relation to that animal is £1.00.
(2) In this article, a "diseased equine animal" means a mammal which is confirmed to be affected with equine infectious anaemia by an appropriate laboratory test.

EXPLANATORY NOTE
(This note is not part of the Order)
Article 2(1) of this Order prescribes the scale of compensation payable where the Secretary of State causes an equine animal to be slaughtered under section 32 of the Animal Health Act 1981 (c.22) in its application to equine infectious anaemia. The Specified Diseases (Notification and Slaughter) Order 2006 (S.I. 2006/2166) amended the Specified Diseases (Notification and Slaughter) Order 1992 (S.I. 1992/3159), insofar as it applies in England, so as to add equine infectious anaemia to the list of diseases to which section 32 of the Animal Health Act 1981 applies.
A regulatory impact assessment of the effect this Order will have on the costs of business has been prepared and placed in the library of each House of Parliament; copies can be obtained from the Surveillance, Zoonoses and Emerging Issues Division, Department for Environment, Food and Rural Affairs, 1A Page Street, London SW1P 4PQ.

Functions conferred under the 1981 Act on "the Minister" and "the Ministers" are now exercisable by the Secretary of State. Functions of "the Ministers", so far as exercisable by the Secretaries of State for Scotland and for Wales, were transferred to the Minister of Agriculture, Fisheries and Food by S.I. 1999/3141. Functions of the Minister of Agriculture, Fisheries and Food were then further transferred to the Secretary of State by S.I. 2002/794.back
