The A249 Trunk Road (Iwade Bypass to Queenborough Improvement) (Prohibition of Certain Classes of Traffic and Pedestrians) Order 2006

The Secretary of State for Transport, in exercise of powers conferred by sections 1(1), 2(1), 2(2) and 122A of the Road Traffic Regulations Act 1984[
1], and of all powers enabling him in that behalf, hereby makes the following Order:
1.
This Order may be cited as the A249 Trunk Road (Iwade Bypass to Queenborough Improvement) (Prohibition of Certain Classes of Traffic and Pedestrians) Order 2006 and shall come into force on 30th May 2006.
2.
In this Order:
"the new Trunk Road" means the length of the new A249 Trunk Road, in both directions, from a point at the nosing of the northbound off slip road and a point at the nosing of the southbound on slip road approximately 400 metres and 690 metres respectively south of Kingsferry Interchange roundabout to a point where the Trunk Road meets the new Cowstead roundabout (south) on the Isle of Sheppey, south of Queenborough, in the Borough of Swale, in the County of Kent;
"recovery vehicle" has the meaning given in paragraph 5 of Schedule 1 to the Vehicle Excise and Registration Act 1994[2];
"carriageway" means a way consisting of, or comprised in, the Trunk Road being a way (other than a cycle track) over which the public have a right of way for the passage of vehicles and a surface suitable for the exercise of that right;
"layby" means any area of carriageway intended for the waiting of vehicles and bounded partly by a traffic sign of the type shown in diagram 1010 in Schedule 6 to The Traffic Sign Regulations and General Directions 2002[3] and partly by the outer edge of the carriageway on the same side of the road as the traffic sign;
"water authority" means a water or sewerage undertaker within the meaning of the Water Industry Act 1991[4].

Save as provided in article 4 below, no person shall cause or permit any—
(a) pedal cycle,
(b) horse ridden by a person,
(c) vehicle drawn by animals,
(d) motor cycle where the cylinder capacity of the engine is less than 50 cubic centimetres,
or
(e) pedestrian,
to enter or proceed along the new Trunk Road in either direction, except upon the direction of, or with the permission of, a police constable in uniform or a traffic warden.
4.
The provisions of article 3 (e) shall not apply to any police officer, or to a pedestrian—
(a) engaged in connection with the maintenance, improvement or reconstruction of the new Trunk Road;
(b) engaged in connection with any building operation or demolition;
(c) engaged in connection with the removal of any obstruction to traffic;
(d) engaged in the laying, erection, alteration or repair of any main, pipe or apparatus for the supply of gas, water or electricity or any telecommunications apparatus as defined in Schedule 2 to the Telecommunications Act 1984[5] in or near the new Trunk Road;
(e) engaged in connection with a local authority or water authority in pursuance of statutory powers or duties;
(f) engaged in connection with ambulance, fire brigade or recovery vehicle purpose;
(g) leaving a vehicle waiting on a layby so long as he or she does not leave the immediate vicinity of that layby;
or
(h) leaving a vehicle that is prevented from proceeding by circumstances beyond his or her control.
