The Secretary of State, in exercise of the powers conferred upon him by section 77(9C) of the Railways Act 1993[
1], and after consultation with the Rail Passengers' Council in accordance with that section, hereby makes the following Order:
Citation and commencement
1.
This Order may be cited as the Railways (Rail Passengers' Council and Rail Passengers' Committees) (Exemptions) (Amendment) Order 2005 and shall come into force on 23rd July 2005.
Interpretation
2.
In this Order, "the 2003 Order" means the Railways (Rail Passengers' Council and Rail Passengers' Committees) (Exemptions) Order 2003[
2].
Amendment of 2003 Order
3.
—(1) The 2003 Order shall be amended as follows.
(2) Article 4 shall cease to have effect.
(3) In article 5(1), for the words "articles 3 and 4 apply" there shall be substituted the words "article 3 applies".
(4) In article 5(2), for the words "Articles 3 and 4 do" there shall be substituted the words "Article 3 does".

EXPLANATORY NOTE
(This note is not part of the Order)
This Order amends the Railways (Rail Passengers' Council and Rail Passengers' Committees) (Exemptions) Order 2003 (S.I. 2003/1695) ("the 2003 Order").
Section 21(1) of the Railways Act 2005 ("the 2005 Act") provides for the abolition of the Rail Passengers' Committees established under section 2(2) of the Railways Act 1993. This provision comes into force on 24th July 2005.
This Order amends the 2003 Order so as to remove references to the Rail Passengers' Committees in anticipation of their abolition. Section 19(6) of the 2005 Act provides for the Rail Passengers' Council established by section 3(2) of the 1993 Act to cease to exist. References to the Rail Passengers' Council in the 2003 Order shall, by virtue of section 19(7) of the 2005 Act, apply to the new Rail Passengers' Council established by section 19(1) of that Act with effect from 24th July 2005 (being the date on which section 19 comes into force).
A full regulatory impact assessment has not been produced for this instrument as it has no impact on the costs of business.
