The Secretary of State for Transport makes this Order in exercise of powers conferred by sections 10 and 12 of the Highways Act 1980[
1] and now vested in him[
2], and of all powers enabling him in that behalf:

This Order may be cited as The A40 Trunk Road (M5 Motorway Junction 11 to the Gloucestershire/Oxfordshire County Boundary) (Detrunking) Order 2005 and shall come into force on 1st July 2005.

In this Order—
(i) "principal road" as a classification for a highway means that the highway is a principal road for the purposes of enactments and instruments which refer to highways classified as principal roads and is also classified for the purpose of every other enactment and instrument which refers to highways classified by the Secretary of State;
(ii) "the trunk road" means the A40 trunk road; and
(iii) "the plan" means the plan folio consisting of the key plan and three site plans numbered HA10/PS/325 marked "The A40 Trunk Road (M5 Motorway Junction 11 to the Gloucestershire/Oxfordshire County Boundary) (Detrunking) Order 2005" signed by authority of the Secretary of State for Transport and deposited at the ODPM-DfT Records Management Branch, Floor 13 (IMD), Ashdown House, St Leonards on Sea, Hastings, East Sussex TN37 7GQ;
3.
From the date when this Order comes into force the length of the trunk road described in the Schedule to this Order shall cease to be a trunk road and shall be classified as a principal road.

THE SCHEDULE
LENGTH OF TRUNK ROAD CEASING TO BE A TRUNK ROAD
The length of trunk road that will cease to be trunk road is the A40 from its junction with the M5 motorway at Junction 11 west of Cheltenham in the County of Gloucestershire to the Gloucestershire/Oxfordshire County boundary for a distance of about 38.2 kilometres (23.7 miles), as illustrated on the plan accompanying the Order.

STATEMENT OF REASONS
The A40 trunk road was identified in the 1998 White Paper "A New Deal for Transport: Better for Everyone" as a trunk road that mainly serves local and regional traffic. During the preparation of the White Paper, widespread consultation was undertaken by the Department of Transport, Local Government and the Regions which indicated significant support for the detrunking of certain roads. The Secretary of State decided that such roads would be more appropriately managed by the local highway authorities to enable decisions to be taken locally, and to be better integrated with local transport and land use planning issues.
Agreement has been reached with Gloucestershire County Council that they will take on responsibility for the safety, maintenance and improvement of the A40 road described in the Schedule to this Order. On making the Order, the Secretary of State will transfer the management of the road to Gloucestershire County Council.
