The Secretary of State for Transport makes this Order in exercise of powers conferred by sections 10 and 41 of the Highways Act 1980[
1] and now vested in him[
2], and of all other powers enabling him in that behalf:
1.
This Order may be cited as the A428 Trunk Road (Caxton Gibbet to Cambourne Improvement) (Detrunking) Order 2005 and shall come into force on 11th April 2005.

In this Order -
(1) all measurements of distance are approximate only, and are measured along the route of the relevant highway. Where junctions are referred to as points of reference in measurements, those measurements are made from the centre line of the junction if it is a `T'-junction and from the centre of the roundabout island if it is a roundabout junction;
(2)
(i) "the plan" means the plan contained in the folio numbered HA 10/MP/023 marked "The A428 Trunk Road (Caxton Gibbet to Cambourne Improvement) (Detrunking) Order 2005", signed by authority of the Secretary of State for Transport and deposited at Records Management Branch, Room F13, Ashdown House, Sedlescombe Road North, St Leonards on Sea, Hastings, East Sussex TN37 7GA;
(ii) "classified road" as a classification for a highway, means that the highway is not a principal road for the purposes of enactments or instruments which refer to highways classified as principal roads but is a classified road for the purpose of every enactment and instrument which refers to highways classified by the Secretary of State and which does not specifically refer to their classification as principal roads;
(iii) "the new trunk road" means the new highway which the Secretary of State proposes to construct referred to in article 2 (iii) of the A428 Trunk Road (Caxton Gibbet to Cambourne Improvement) Order 2005[3]; and
(iv) "the trunk road" means the A428 Trunk Road.

The length of trunk road described in the Schedule to this Order shall cease to be a trunk road and shall be classified as a classified road from the date on which the Secretary of State notifies the Cambridgeshire County Council that the new trunk road is open for traffic.
4.
The centre line of the trunk road is indicated by heavy black dashes on the plan.

THE SCHEDULE
LENGTH OF THE TRUNK ROAD CEASING TO BE A TRUNK ROAD
The route of the trunk road ceasing to be a trunk road is a 990 metre length which runs from the Caxton Gibbet Roundabout to a point 160 metres east of Elsworth Road.
