HOUSING, ENGLAND
The Housing Act 2004 (Commencement No. 2) (England) Order 2005
The Secretary of State, in exercise of the powers conferred upon him by section 270(4) and (5) of the Housing Act 2004[
1] hereby makes the following Order:
Citation and application
1.
- (1) This Order may be cited as the Housing Act 2004 (Commencement No. 2) (England) Order 2005.
(2) This Order applies to England only.
Commencement
2.
Section 223 of the Housing Act 2004 (allocation of housing accommodation by local authorities) shall come into force on 27th April 2005.

EXPLANATORY NOTE
(This note is not part of the Order)
This Order brings section 223 of the Housing Act 2004 into force in England on 27th April 2005. Section 223 amends section 167(2)(d) of the Housing Act 1996 which provides that a local housing authority's scheme for allocating housing accommodation must be framed so as to secure that reasonable preference is given to people who need to move on medical or welfare grounds. The amendment provides that "medical or welfare grounds" include grounds relating to a disability.
