The Secretary of State, in exercise of the powers conferred by section 7 of the Access to Justice Act 1999[
1], and now vested in him[
2], makes the following Regulations:
1.
These Regulations may be cited as the Community Legal Service (Financial) (Amendment No. 2) Regulations 2005 and shall come into force forthwith.
2.
In regulation 3 of the Community Legal Service (Financial) Regulations 2000[
3]-
(a) in paragraph (1), at the end insert -
"
;
(i) Legal Help or Legal Representation for a person who is subject to a control order, consisting of advice in connection with that order, help with an application to the Secretary of State under section 7(1) of the Prevention of Terrorism Act 2005[4], or representation in control order proceedings";
(b) in paragraph (2), after the definition of "Central Authority", insert -
"
"control order" and "control order proceedings" have the same meanings as in the Prevention of Terrorism Act 2005;".

EXPLANATORY NOTE
(This note is not part of the Regulations)
These Regulations amend regulation 3 of the Community Legal Service (Financial) Regulations 2000 to make legal help and representation under the Community Legal Service available to a person subject to a control order under the Prevention of Terrorism Act 2005 without reference to the person's financial resources.
