The Secretary of State, in exercise of the powers conferred upon her by section 84(1) of the Animal Health Act 1981[
1], and with the approval of the Treasury, makes the following Order:
Title, commencement and application
1.
This Order may be cited as the Diseases of Animals (Fees for the Testing of Disinfectants) (England) Order 2005, comes into force on 1st April 2005 and applies to England only.
Fees for the testing of disinfectants
2.
A person who submits a disinfectant for testing under article 7 of the Diseases of Animals (Approved Disinfectants) Order 1978[
2] shall, when he submits the disinfectant for testing, pay to the Secretary of State the fees set out in the Schedule to this Order.
Revocation
3.
The Diseases of Animals (Fees for the Testing of Disinfectants) Order 1991[
3] is revoked insofar as it applies to England.

EXPLANATORY NOTE
(This note is not part of the Order)
This Order, which applies to England only, revokes and replaces the Diseases of Animals (Fees for the Testing of Disinfectants) Order 1991 ("the 1991 Fees Order") (S.I. 1991/1168). The Order:
(i) retains the previous fee for the administrative cost of dealing with applications for approvals under article 7 of the Diseases of Animals (Approved Disinfectants) Order 1978 (S.I. 1978/32);
(ii) removes the requirement for the payment of a fee for the testing of a disinfectant's identity, corrosive effect and stability; and
(iii) increases the fees payable for the testing of disinfectants submitted for approval.
The fees payable under the 1991 Fees Order are set out in the second column of the new Fees table.
