In exercise of the powers conferred upon the Secretary of State by sections 408 and 537A(1) and (2) of the Education Act 1996[
1], and having consulted those persons with whom consultation appeared to him to be desirable, the Secretary of State for Education and Skills hereby makes the following Regulations:
Citation, commencement and application
1.
- (1) These Regulations may be cited as the Education (School Performance Information) (England) (Amendment) Regulations 2005 and shall come into force on 10th February 2005.
(2) These Regulations apply to maintained schools (other than those established in hospitals) in England.
Amendment of Regulations

The Education (School Performance Information) (England) Regulations 2001[
2] shall be amended in accordance with regulations 3 and 4.

In regulation 2(1), insert the following definition -
"
"the Document" means the document entitled "Foundation Stage and Key Stage 1 Assessment and Reporting Arrangements" published by the Qualifications and Curriculum Authority pursuant to section 87(11) of the Education Act 2002 and article 9 of the Education (National Curriculum) (Key Stage 1 Assessment Arrangements) (England) Order 2004[3];".
4.
In paragraph 1 of Schedule 1 -
(a) replace sub-paragraph (2) with the following paragraph -
"
(2) In respect of each such pupil, the information required by the Document in respect of each core subject and each attainment target in relation to each core subject.";
(b) delete sub-paragraph (3).

EXPLANATORY NOTE
(This note is not part of the Regulations)
These Regulations further amend the Education (School Performance Information) (England) Regulations 2001 to reflect changes made to the assessment requirements for Key Stage 1 under the Education (National Curriculum) (Key Stage 1 Assessment Arrangements) (England) Order 2004. This amendment requires schools to provide local education authorities with the information specified in the Assessment and Reporting Arrangements Document for Key Stage 1. This refers to teacher assessment of each pupil's level of attainment in English, mathematics and science.
