The First Secretary of State, in exercise of the powers conferred upon him by sections 21, 91 and 93 of the Planning (Listed Buildings and Conservation Areas) Act 1990[
1] hereby makes the following Regulations:
Citation, commencement and application
1.
- (1) These Regulations may be cited as the Planning (Listed Buildings and Conservation Areas) (Amendment) (No. 2) (England) Regulations 2004 and shall come into force on 14th January 2005.
(2) These Regulations apply in relation to England only.
Amendments to the Planning (Listed Buildings and Conservation Areas) Regulations 1990
2.
In the following provisions of the Planning (Listed Buildings and Conservation Areas) Regulations 1990[
2], for "three" substitute "six" -
(a) regulation 8(1) (appeals); and
(b) Parts I, II and III of Schedule 1 (notices to be sent to applicant).

EXPLANATORY NOTE
(This note is not part of the Regulations)
These Regulations, which apply in relation to England only, amend regulation 8 of, and Parts I, II and III of Schedule 1 to, the Planning (Listed Buildings and Conservation Areas) Regulations 1990 by altering the time limit for appeals from three to six months.
A Regulatory Impact Assessment has been prepared in relation to these Regulations. It has been placed in the Library of each House of Parliament and copies may be obtained from PDCD D, Office of the Deputy Prime Minister, Eland House, Bressenden Place, London SW1E 5DU (Telephone 020-7944-3936).
