HIGHWAYS, ENGLAND

The A590 Trunk Road (Whitestone to Cartmel Lane) (Detrunking) Order 2004

  Made 30th November 2004 
  Coming into force 17th December 2004 

The Secretary of State for Transport makes this Order in exercise of powers conferred by sections 10 and 12 of the Highways Act 1980[1] and now vested in him[2], and of all other enabling powers: - 

     1. This Order may be cited as the A590 Trunk Road (Whitestone to Cartmel Lane) (Detrunking) Order 2004 and shall come into force on 17th December 2004.

    
2. In this Order - 

      (i) "classified road" and a classification for a highway, means that the highway is not a principal road for the proposes of enactments or instruments which refer to highways classified as principal road but is a classified road for the purpose of every enactment and instrument which refers to highways classified by the Secretary of State and which does not specifically refer to their classification as principal roads;

      (ii) "the new trunk roads" [
      3]means the new highways which the Secretary of State proposes to construct referred to in article 2(2)(ii) of the A590 Trunk Road (High and Low Newton Bypass and Slip Roads) Order 2004;

      (iii) "the trunk road" means the Levens Bridge to Carlisle Trunk Road (A590).

     3. The length of the trunk road described in the Schedule to this Order shall cease to be a trunk road and shall be classified as a classified road from the date on which the Secretary of State notifies the County Council of Cumbria that the new trunk roads are open for traffic.

LENGTH OF THE TRUNK ROAD CEASING TO BE A TRUNK ROAD


The length of the trunk road ceasing to be a trunk road is situated between Whitestone and Cartmel Lane at the points marked "A" and "B" respectively and is shown by broad black dashes on the plan numbered HA 10/2-/N234, marked "A590 Trunk Road (Whitestone to Cartmel Lane) (Detrunking) Order 2004", signed by authority of the Secretary of State for Transport and deposited at DfT Records Management Branch, Ashdown House, St Leonards on Sea, Hastings, East Sussex TN37 7GA.
