CUSTOMS AND EXCISE

The Export of Goods, Transfer of Technology and Provision of Technical Assistance (Control) (Amendment) Order 2004

  Made 1st April 2004 
  Laid before Parliament 6th April 2004 
  Coming into force 1st May 2004 

The Secretary of State in exercise of the powers conferred upon her by sections 1, 5 and 7 and having regard to the matters specified in section 8, of the Export Control Act 2002[1] hereby makes the following Order:

     1. This Order may be cited as the Export of Goods, Transfer of Technology and Provision of Technical Assistance (Control) (Amendment) Order 2004 and shall come into force on 1st May 2004.

    
2. For the entry at paragraph c of PL 5001 in Part 1 of Schedule 1 to the Export of Goods, Transfer of Technology and Provision of Technical Assistance (Control) Order 2003 [2], there shall be substituted the following entry:

      " c. Restraints specially designed for restraining human beings, as follows:

      1. Leg-irons;

      2. Gangchains;

      3. Electric-shock belts;

      4. Shackles having a maximum locked dimension exceeding 240mm overall (i.e. including cuffs and connecting chain);

      5. Individual cuffs having an internal perimeter dimension exceeding 165mm when the rachet is engaged at the last notch entering the locking mechanism and shackles made therewith; ".

EXPLANATORY NOTE

(This note is not part of the Order)


This Order, made under the Export Control Act 2002, amends the Export of Goods, Transfer of Technology and Provision of Technical Assistance (Control) Order 2003 ('the 2003 Order').

Article 2 substitutes a new entry in Part 1 of Schedule 1 to the 2003 Order in respect of restraints specially designed to restrain human beings.

A full regulatory impact assessment has not been produced for this instrument as it has no impact on the costs of business.
