The Secretary of State, in exercise of the powers conferred by sections 4, 5 and 7 of the Export Control Act 2002[
1], hereby makes the following Order:
Citation and commencement
1.
- (1) This Order may be cited as the Trade in Controlled Goods (Embargoed Destinations) (Amendment) Order 2004 and shall come into force on 9th April 2004.
(2) In this Order, "the principal Order" means the Trade in Controlled Goods (Embargoed Destinations) Order 2004[
2].
Amendment to the principal Order
2.
In Article 8(4) of the principal Order, for the reference to "article 3" there shall be substituted a reference to "paragraph (1)".

EXPLANATORY NOTE
(This note is not part of the Order)
This Order corrects an error made in the Trade in Controlled Goods (Embargoed Destinations) Order 2004 (SI 2004/318) so as to clarify that the defence in article 8(4) applies in respect of the offence created by article 8(1), which provides that any person who contravenes a prohibition or restriction in article 3 (supply and delivery of controlled goods) shall be guilty of a summary offence.
A full regulatory impact assessment has not been produced for this instrument as it has no impact on the costs of business.
