The Secretary of State for Transport, in exercise of the powers conferred by sections 75 and 104(1) of the New Roads and Street Works Act 1991[
1] hereby makes the following Regulations: -
Citation and commencement
1.
These Regulations may be cited as the Street Works (Inspection Fees) (England) (Amendment) Regulations 2004 and shall come into force on 1st April 2004.
Preliminary
2.
The Street Works (Inspection Fees) (England) Regulations 2002[
2] shall be amended as follows.
Amendment to regulation 3 (inspection fees)
3.
In regulation 3, in paragraphs (1) and (8), for "£20.00" there shall be substituted "£21.00".

EXPLANATORY NOTE
(This note is not part of the Regulations)
These Regulations amend the Street Works (Inspection Fees) (England) Regulations 2002 so as to increase the fee payable by undertakers for inspections of their work by street authorities in England under regulation 3 of those Regulations.
The fee for such inspections, which was last altered in October 2002, is increased by 5% from £20 to £21.
A Regulatory Impact Assessment of these Regulations has been made and copies have been placed in the libraries of both Houses of Parliament. Copies of the Assessment can be obtained from the Department for Transport, Zone 3/24, Great Minster House, 76 Marsham Street, London SW1P 4DR (Tel: 020 7944 2485). The Assessment may also be found by visiting the Department's website at
www.dft.gov.uk.
