The Secretary of State for Education and Skills, in exercise of the powers conferred upon him by sections 527A(5) and 569 of the Education Act 1996[
1] hereby makes the following Regulations:
Citation and commencement.
1.
These Regulations may be cited as the Local Education Authority (Behaviour Support Plans) (Exception) (England) Regulations 2003 and shall come into force on 1st January 2004.
Removal of requirement to publish revised plan.
2.
Regulation 5(3)(b) of the Local Education Authority (Behaviour Support Plans) Regulations 1998[
2] shall not apply to the local education authorities listed in the Schedule.

EXPLANATORY NOTE
(This note is not part of the Regulations)
The Local Education Authority (Behaviour Support Plans) Regulations 1998 (S.I. 1998/644) require local education authorities to publish a revised plan in 2001, between 1st January and 1st April, and in the same period every third year thereafter.
These Regulations remove the requirement to publish a revised plan in every third year in respect of two groups of local education authorities; those which were categorised as excellent in the Comprehensive Performance Assessment in 2003 and achieved a 3-star rating for performance in education, and those which are preparing a pilot Single Education Plan.
The removal of the date for publishing a revised plan contained in regulation 5(3)(b) of the 1998 Regulations also means that there will be no requirement for the listed local education authorities to consult or publish in accordance with regulations 3 and 4 of the 1998 Regulations.
