The Secretary of State for Transport makes this Instrument in exercise of powers conferred by section 106(3) of the Highways Act 1980[
1] and now vested in him[
2] and of all other powers enabling him in that behalf:
1.
This Instrument may be cited as The City of Westminster (Paddington Station LTVA General Arrangement Bishops Bridge North Bridge) Scheme 2001 Confirmation Instrument 2003 and shall come into force on the date on which notice that it has been confirmed is first published in accordance with paragraph 1 of Schedule 2 to the Highways Act 1980.
2.
The City of Westminster (Paddington Station LTVA General Arrangement Bishops Bridge North Bridge) Scheme 2001 ("the Scheme") is hereby confirmed with modifications.
3.
The Scheme as confirmed is set out in the Schedule hereto (including the plan) and copies of the Scheme with its accompanying plan as modified are deposited at the offices of the Department for Transport, Floor 13 (IMD), Ashdown House, St Leonards On Sea, Hastings, East Sussex TN37 7GA, and at the offices of the Westminster City Council at One Stop Services, Westminster City Hall, 64 Victoria Street, London SW1E 6QP.

THE SCHEDULE
THE CITY OF WESTMINSTER (PADDINGTON STATION LTVA GENERAL ARRANGEMENT BISHOPS BRIDGE NORTH BRIDGE) SCHEME 2001
THE LORD MAYOR AND CITIZENS OF THE CITY OF WESTMINSTER (hereinafter referred to as "the Corporation") make this Scheme in exercise of their powers under section 106(3) of the Highways Act 1980 and of all other powers enabling them in that behalf:

The Corporation are authorised to construct over the navigable waters of the Grand Union Canal the bridge specified in the Schedule to this Scheme being a replacement for the existing bridge and as part of the highway which they are proposing to improve between the junction of Bishops Bridge Road and Eastbourne Terrace (Paddington Station) and Harrow Road gyratory in the City of Westminster.
2.
This Scheme may be cited as The City of Westminster (Paddington Station LTVA General Arrangement Bishops Bridge North Bridge) Scheme 2001.
THE SCHEDULE TO THE SCHEME
PLAN AND SPECIFICATION OF THE PADDINGTON STATION LTVA GENERAL ARRANGEMENT BISHOPS BRIDGE NORTH BRIDGE
Location
The location and general design of the Bridge are shown on Drawing No. LN00328/SK202A and marked "Illustrative Arrangement Bishop's Bridge North (Canal Bridge) Bridge Order".
The Bridge will be on the same site as the existing bridge that carries Bishop's Bridge Road and the Grand Union Canal.
Points of Commencement and Termination
From a point on the northern bank of the Grand Union Canal, 0.67 metres from the face of the property known as 63/65 North Wharf Road W2.
To a point on the southern bank of the Grand Union Canal, 30.65 metres from the face of the property known as 63/65 North Wharf Road W2.
Span(s)
A single span of 31.00 metres (nominal).
Headway of Main Navigable Channel
Not less than 3.00 metres above the existing water level of 29.50 metres.
Waterway
A minimum clear navigable waterway of 7.80 metres.
Overall Dimensions
The Bridge will be typically 26.91 metres wide overall and will carry a 21.31 metre wide six lane carriageway, with a 0.61 metre wide hard strip and a footway of 2.40 metres width on either side.
EXPLANATORY NOTE
(This note is not part of the scheme)
The Secretary of State has modified this scheme as follows:
(i) The word "they" in the first line of article 2 of the Order has been replaced with "The".
(ii) In the Schedule to the scheme, the measurement of the single span of the bridge has been amended (from 30 metres to 31 metres).
(iii) In the Schedule to the scheme, the measurement of the water level of the waterway has been amended (from 29.47 metres to 29.50 metres).
(iv) Plan number LN00328/SK202A marked "Illustrative Arrangement Bishop's Bridge North (Canal Bridge) Bridge Order" has been substituted for Plan number LN00328/SK201A of the same title.
