The Secretary of State for Transport, in exercise of the powers conferred by section 11 of the Consumer Protection Act 1987[
1] and of all other powers enabling him in that behalf, and after consultation in accordance with section 11(5) of that Act with such organisations as appear to him to be representative of interests substantially affected by the following Regulations, such other persons as he considers appropriate, and the Health and Safety Commission in relation to the application of the following Regulations to Great Britain, hereby makes the following Regulations: -
Citation and commencement
1.
These Regulations may be cited as the Motor Vehicle Tyres (Safety) (Amendment) (No. 2) Regulations 2003 and shall come into force on 1st January 2004.
Amendment of the Motor Vehicle Tyres (Safety) Regulations 1994
2.
- (1) The Motor Vehicle Tyres (Safety) Regulations 1994[
2] shall be further amended in accordance with the following provision of this regulation.
(2) In regulation 7(5) (supply of part-worn tyres for certain vehicles) (as it is to be substituted by regulation 4 of the Motor Vehicle Tyres (Safety) (Amendment) Regulations 2003[
3]) at the beginning of sub-paragraph (b), there shall be inserted the words "an approval mark,".

EXPLANATORY NOTE
(This note is not part of the Regulations)
These Regulations further amend the Motor Vehicle Tyres (Safety) Regulations 1994 by reinstating the requirement that part-worn tyres bear an approval mark. This corrects an omission from the Motor Vehicle Tyres (Safety) (Amendment) Regulations 2003.
No regulatory impact assessment has been prepared in respect of these Regulations as no additional costs or savings are anticipated as a consequence of the Regulations coming into force, other than those already identified in the assessment prepared in respect of the Motor Vehicle Tyres (Safety) (Amendment) Regulations 2003. Copies of that regulatory impact assessment can be obtained from the Department for Transport, Zone 2/04, Great Minster House, 76 Marsham Street, London SW1P 4DR. A copy was placed in the library of each House of Parliament.
