The Secretary of State for Health, in exercise of the powers conferred upon him by section 12 of the Community Care (Delayed Discharges etc.) Act 2003[
1] and of all other powers enabling him in that behalf, hereby makes the following Order:
Citation, commencement and application
1.
- (1) This Order may be cited as the Delayed Discharges (Mental Health Care) (England) Order 2003 and shall come into force on 1st October 2003.
(2) This Order applies to England only.
Definition of "mental health care"
2.
For the purposes of the definition of "mental health care" in section 12 of the Community Care (Delayed Discharges etc.) Act 2003 health services relating to mental health are of a prescribed description if they are -
(a) psychiatric services; or
(b) other services provided to a patient for the purposes of the prevention, diagnosis or treatment of illness,
where the person primarily responsible for arranging those services is a consultant psychiatrist.

EXPLANATORY NOTE
(This note is not part of the Order)
This Order prescribes for the purposes of the definition of "mental health care" in section 12 of the Community Care (Delayed Discharges etc.) Act 2003 those health services relating to mental health which are "mental health care".
