The Release of Short-Term Prisoners on Licence (Repeal of Age Restriction) Order 2003

Coming into force in accordance with article 1
Whereas a draft of this Order has been laid before Parliament and approved by a resolution of each House, in accordance with section 34A(6) of the Criminal Justice Act 1991[1];
Now, therefore, the Secretary of State, in exercise of the power conferred on him by section 34A(5)(a) of the Criminal Justice Act 1991, hereby makes the following Order:
Citation and commencement 1.
This Order may be cited as the Release of Short-Term Prisoners on Licence (Repeal of Age Restriction) Order 2003 and shall come into force on the expiry of seven days after the day on which it is made.
Repeal of age restriction 2.
In section 34A(1) of the Criminal Justice Act 1991, the words "aged 18 or over" are repealed.

This Order amends section 34A(1) of the Criminal Justice Act 1991 so that the age restriction for early release under that section is removed. This means that short-term prisoners under the age of 18 will be eligible for release on licence under section 34A(3).
