The Secretary of State, in exercise of powers conferred by sub-paragraph (5) of paragraph 2 of Schedule 4 to the Children Act 1989[1], after consultation in accordance with that sub-paragraph with the Aycliffe School Trust, the voluntary organisation by which the Aycliffe controlled community home (now known as the Aycliffe Young People's Centre) is provided, and with Durham County Council, the local authority which is specified in the Aycliffe School Instrument of Management Order 1973[2], and of all other powers enabling him in that behalf, hereby makes the following Order: -
Citation and commencement
1.
This Order may be cited as the Aycliffe Instrument of Management (Variation) Order 2003 and shall come into force on 19th July 2003.
Variation of the Aycliffe School Instrument of Management Order 1973
2.
In Article 9(2) of the Aycliffe School Instrument of Management Order 1973, for "70" there shall be substituted "72".

EXPLANATORY NOTE
(This note is not part of the Order)
This Order amends the Instrument of Management for the controlled community home which is now known as the Aycliffe Young People's Centre.
The Instrument of Management makes provision for the appointment of a body of managers of the Centre. By Article 9 of the Instrument of Management, a person is disqualified from being appointed as a manager, and a manager is to cease to act as such, on attaining the age of 70. Article 9 is amended by article 2 of this Order so that this age is increased to 72.
Copies of the Aycliffe School Instrument of Management Order 1973 and the two previous Orders which amend that Order may be obtained from the Fostering and Residential Care Placements Team, Room 141, Department for Education and Skills, Wellington House, 133-155 Waterloo Road, London SE1 8UG.
